By browsing www.myrecruit.ro, contacting us through the form, selecting "Contact" or "Submit your CV", or sending your CV to contact@myrecruit.ro or flavia@myrecruit.ro, you declare that you have been correctly informed about data processing by reading this document, the "Privacy Notice", and that you give your consent to the processing of your data in accordance with the terms and conditions described below.

1. DEFINITIONS

"www.myrecruit.ro" (or "the Website") is a presentation website owned and administered by S.C. My Recruit S.R.L with registered office at Bulevardul Chimiei nr 101, spatiul comercial 5, Iasi, jud. Iasi, phone 0752512998, VAT code 45844212 Trade Register number J2022000353270.

"Data Controller" means a natural person or legal entity that decides on the nature and limits of data processing. In accordance with Regulation (EU) 679/2016 (applicable in Romania since 25 May 2018), MY RECRUIT is the data controller.

"GDPR" refers to Regulation (EU) 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

"Personal data" means any information relating to an identified or identifiable natural person ("data subject").

"Data subject" refers to the person whose personal data is being processed — a person who is identified or identifiable, directly or indirectly, in particular by reference to an identifier such as name, identification number, location data, an online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.

"Processing of personal data" means any operation or set of operations performed on personal data, whether or not carried out by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

2. PRINCIPLES

MY RECRUIT's data protection policy is based on the following principles:

Personal data will be processed lawfully, fairly, and transparently.
Personal data collected will be used only for specified, explicit, and legitimate purposes, and will be processed only to the extent necessary for the purpose of processing.
Personal data will be accurate and, where necessary, kept up to date. All necessary measures will be taken to ensure that inaccurate data is deleted or corrected promptly.

5. INFORMATION COLLECTED

In general, you are not required to provide personal data when visiting our website. However, we may ask you to provide certain personal data in order to receive additional information about our services and/or to register your CV in our database.

5.1. Information provided voluntarily

By applying for a job, submitting your CV via the application form on the Website, or contacting us through other methods (phone, email, etc.), you may provide the following information: first name and surname, age, email address, gender, home/residence address, occupation, social media profile, education, photograph, work experience, foreign languages, professional skills, as well as other data contained in your CV relating to hobbies, qualifications, or areas of interest for employment.

When you use the website contact form or communicate with us in any other way, you voluntarily provide information that we process. This information includes: first name and surname, postal address, email address, and phone number.

By providing this information, we commit to keeping it safe and confidential in our database. We do not disclose or transfer information to third parties.

5.2. Automatically collected information

When you browse our website, we may collect information about your visit. This information may include your IP address, operating system, browser, browsing activity, and other information about how you interacted with the website. This information may be collected using cookies or similar technologies. The website www.myrecruit.ro is secured with HTTPS for the transfer of information between the server and users. All forms included on this website do NOT publicly store personal data — they transmit it via email services to the owner. Data transmitted by email may be stored by third parties such as internet service providers, local networks, or email service providers, in accordance with applicable legislation.

Personal data collected through this website may be stored in internal computer systems owned by the owner for the purpose of preparing a commercial offer or fulfilling legal/contractual obligations. MY RECRUIT commits to managing stored data securely and only for specified commercial purposes.

6. LEGAL BASIS FOR PROCESSING PERSONAL DATA

With regard to data you provide voluntarily by completing and submitting the application or contact form, or by contacting us in any other way, the legal basis is the performance of pre-contractual measures taken at the request of the data subject (Article 6(1)(b) of Regulation (EU) 679/2016 — GDPR).

Both under current legislation and the GDPR, your consent is not required when processing is necessary for the performance of pre-contractual measures, compliance with a legal obligation, or for legitimate interests.

With regard to data we collect automatically through the use of cookies or similar technologies, the legal basis for processing is consent. By accessing the website, you validly express your consent to processing. Consent is not a precondition for establishing a business relationship and does not create contractual obligations.

7. PURPOSES OF COLLECTING PERSONAL DATA

Your data is collected solely for the following purposes:

Taking the necessary steps for the conclusion of a contract.

In addition to the above, if you are a job candidate, to the extent permitted by applicable law, we use the information described in this Notice for the following purposes:

Identifying skill gaps.

8. DATA SECURITY AND INTEGRITY

We also make reasonable efforts to retain personal data only for the period necessary to comply with a request from a person, or until that person requests its deletion.

9. DATA RETENTION PERIOD

We store personal data collected in our systems in a form that permits identification of data subjects for a limited period of time necessary in light of the purposes for which the data was collected or for which it is subsequently processed. We determine this specific period of time taking into account:

The need to retain personal data in order to provide our services.
The protection of the legitimate interests of the data controller, in accordance with this Privacy Notice.
The existence of specific legal obligations requiring processing and storage for a defined period of time.

10. TRANSFER OF DATA TO THIRD COUNTRIES

We will not communicate or transfer to any third party any of the personal data collected from you or about you, except in the following cases:

Public authorities and institutions — where there is a legal obligation to do so, or for the purpose of a legitimate interest (e.g. defence of the Company's rights in contentious or non-contentious proceedings).

Contractual partners or collaborators of the Company who provide us with web hosting, website development, website maintenance, online marketing, and marketing communications services, or other companies with which MY RECRUIT may develop joint market offerings of products and/or services.

Any third party — where you have given your express and specific consent for the respective situation and the respective data.

Where personal data processed by the Company is transferred — directly or through its contractual partners/collaborators — outside the European Economic Area, we ensure that such transfers take place in compliance with the GDPR (in particular Article 46 of the GDPR), the applicable legal provisions in this area, on the basis of appropriate safeguards (standard data protection clauses adopted by the Commission), and subject to the existence of enforceable rights and effective remedies for data subjects.

11. RIGHTS OF THE DATA SUBJECT

Right to withdraw consent: Where processing is based on consent, you have the right to withdraw your consent at any time and without any charge, by sending an email to contact@myrecruit.ro with the subject line "Withdrawal of consent for personal data processing".

Right to information and access: You have the right to obtain confirmation from us as to whether personal data concerning you is being processed, and if so, the right to access that data.

Right to rectification: You have the right to obtain from us, without undue delay, the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed, including by providing a supplementary statement.

Right to erasure ("right to be forgotten"): In situations where (i) the data is no longer necessary for the purposes for which it was collected, (ii) consent has been withdrawn and there is no other legal basis for processing, (iii) you object to the processing and there are no overriding legitimate grounds, or (iv) the personal data has been unlawfully processed, you have the right to obtain erasure of your personal data without undue delay.

Right to restriction of processing: You have the right to obtain restriction of processing where: (i) you contest the accuracy of the data, for a period enabling us to verify its accuracy; (ii) the processing is unlawful and you oppose erasure and request restriction instead; (iii) we no longer need the data for processing purposes but you require it for the establishment, exercise, or defence of legal claims; or (iv) you have objected to processing pursuant to Article 21(1) GDPR, pending verification of whether our legitimate grounds override your rights.

Right to data portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format, and to transmit that data to another controller, where the processing is based on consent or on a contract and is carried out by automated means.

Right not to be subject to automated decision-making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, subject to the exceptions provided for in Article 22 GDPR.

Right to lodge a complaint: You have the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP) and to seek judicial remedy.
